Can A St Louis Bankruptcy Help Me Get Back My Repossessed Car?


Yes, it absolutely can. The main way in which to do that is by filing a St. Louis Chapter 13 bankruptcy. A Chapter 13 is described as a repayment plan over the course of three (3) to five (5) years, during which certain debts are paid back. As soon as the Missouri Chapter 13 is filed, the car creditor is contacted and informed of the case number (and the creditor has to return the car back to you).

But there are a few things that you will need to keep in mind about this process. Some of things are pretty straight forward, but other items are a bit more complex. Here is a short list:

  1. The state of Missouri requires that if a car is repossessed, the creditor must send you two different notifications (usually sent by mail) that indicates their intent to repossess the vehicle.
  2. Once the car is repo’ed, the creditor must hold the vehicle for ten (10) days before re-selling it.
  3. If a Ch13 is filed (and the car has not yet re-sold), then before the creditor will release the vehicle, you must provide proof of automobile insurance.

After you get the car back (which is usually within 24 hours after the Chapter 13 is filed), you will thereafter make a monthly payment to the Bankruptcy Trustee. It is the Trustee’s job to disperse funds to various creditors over the three to five year period. These debts would include: car loans, mortgage arrearage, tax debts, back child support, most of the attorney fees, and possibly a portion of your unsecured debt (like credit cards, medical bills, and payday loans; but it is always the goal to get most of your unsecured debts discharged).


Your attorney would figure out what exactly the monthly payment would need to be. This payment should be no more (and no less) than what is necessary in order to successfully complete the repayment plan. In other words, your lawyer has no incentive to make your plan payment one cent higher than it needs to be.
